SMB Digital Marketing (“SMB-DM,” “we,” “our,” or “us”) provides an AI-powered website platform for small businesses. Our service includes:

• AI-generated professional website redesigns tailored to your business and industry
• Automated SEO-optimized blog content published twice per week
• Built-in analytics dashboard with traffic, conversion, and performance metrics
• On-demand website change requests (up to 5 per month included)
• Custom domain connection with free SSL certificate
• Weekly and monthly performance reports delivered by email

By accessing or using SMB-DM, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Subscription Terms

• The SMB-DM service is offered as a monthly subscription at $99.95 per month.
• Your subscription begins when you complete payment and automatically renews each month until canceled.
• We offer a 30-day money-back guarantee. If you are not satisfied within the first 30 days, contact us for a full refund.
• All payments are processed securely through Stripe. We do not store your credit card information on our servers.
• Prices may change with 30 days' written notice. Existing subscribers will be notified by email before any price change takes effect.

3. User Responsibilities

As a user of SMB-DM, you agree to:

• Provide accurate and complete business information for your website
• Ensure you have the rights to any content, images, or logos you submit to us
• Maintain the security of your account credentials and notify us of any unauthorized access
• Use the service only for lawful business purposes
• Keep your contact information up to date so we can reach you regarding your account

4. Acceptable Use

You may not use SMB-DM to:

• Host, distribute, or promote illegal content or activities
• Send spam, unsolicited communications, or engage in phishing
• Distribute malware, viruses, or other harmful software
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the service in any way that could damage, disable, or impair our infrastructure

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Intellectual Property

• Your content: You retain ownership of all business content, logos, images, and text you provide to us. By submitting content, you grant us a license to use it solely for the purpose of providing the service.
• Our platform: SMB-DM owns all rights to the platform code, infrastructure, AI models, and proprietary systems used to deliver the service.
• Generated websites: Websites generated by our AI use standard open-source frameworks (such as Next.js and Tailwind CSS). The generated site code and design are provided for your use as part of your active subscription.
• Blog content: AI-generated blog posts published to your site are owned by you for the duration of your subscription.

6. Service Level

• We strive to maintain 99.9% uptime for all hosted websites and the SMB-DM dashboard.
• Scheduled maintenance windows will be communicated in advance whenever possible.
• While we optimize your site for search engine visibility and conversions, we do not guarantee specific traffic volumes, search rankings, or revenue results.
• The service is provided “as is” and “as available.” We make no warranties, express or implied, regarding the suitability of the service for your particular business needs.

7. Cancellation

• You may cancel your subscription at any time through your dashboard or by contacting support.
• Upon cancellation, your site remains active until the end of your current billing period.
• After your subscription ends, your website will be taken offline. Your data (site files, analytics, content) will be retained for 90 days in case you wish to reactivate.
• After the 90-day retention period, all data associated with your account will be permanently deleted.
• Refunds for partial months are not provided, except under the 30-day money-back guarantee for new subscribers.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• SMB-DM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
• Our total liability for any claim arising from or related to the service shall not exceed the amount you paid to SMB-DM in the twelve (12) months preceding the claim.
• We are not liable for any downtime, data loss, or service interruptions caused by third-party providers, force majeure events, or circumstances beyond our reasonable control.

9. Modifications to Terms

We may update these Terms of Service from time to time. When we make changes, we will update the “Last updated” date at the top of this page. For material changes, we will notify active subscribers by email. Your continued use of the service after changes are posted constitutes acceptance of the updated terms.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or the use of the service shall be resolved through binding arbitration, except where prohibited by law.
